Compliance in Irish Lettings: What Landlords Need to Know in 2026

Letting a property in Ireland carries significant legal responsibilities. While demand remains strong, landlords must ensure they are operating within a structured and compliant framework.

Compliance is not just about avoiding penalties — it protects your investment, supports a stable tenancy, and ensures long-term rental performance.

RTB Registration

All private residential tenancies must be registered with the Residential Tenancies Board (RTB).

Registration ensures:

  • Legal recognition of the tenancy

  • Access to dispute resolution

  • Transparency in rent history

Failure to register can result in penalties and complications if disputes arise.

Setting Rent and Rent Review Rules

Under the updated rules applying from March 2026, rent must be set in line with market rent at the start of a tenancy, supported by comparable evidence from the RTB rent register.

Once a tenancy begins:

  • Rent can only be reviewed every 12 months

  • Increases are capped at 2% or inflation (whichever is lower)

Landlords must follow strict notice requirements and provide supporting evidence when setting or reviewing rent.

Lease Agreements and Documentation

A clear written lease agreement is essential. It should outline:

  • Rent and payment terms

  • Deposit conditions

  • Responsibilities of both landlord and tenant

  • Duration and conditions of the tenancy

Well-drafted agreements reduce misunderstandings and provide clarity if issues arise.

BER Certificates (Building Energy Rating)

A valid BER certificate must be provided when advertising and letting a property.

The BER rating:

  • Indicates the energy efficiency of the property

  • Affects tenant demand and achievable rent

  • Is increasingly important as energy standards become more central to housing policy

Improving BER can enhance both rental value and long-term asset performance.

Minimum Standards and Property Condition

Landlords must ensure the property meets minimum rental standards, including:

  • Safe electrical and gas installations

  • Adequate heating and ventilation

  • Fire safety measures

  • Proper structural condition

  • Sufficient sanitary and cooking facilities

In coastal and rural areas of West Cork, exposure to weather can increase wear and tear, making ongoing maintenance and inspections particularly important.

Deposit Handling

Deposits must be handled fairly and returned in line with legislation, subject to lawful deductions.

Clear documentation of the property’s condition at the start and end of a tenancy is essential to avoid disputes.

Anti-Money Laundering (AML) Requirements

Lettings activity may fall within Anti-Money Laundering regulations. Landlords and agents must carry out appropriate identification checks and maintain proper documentation.

Why Compliance Matters

A compliant approach:

  • Reduces legal and financial risk

  • Protects rental income

  • Supports longer, more stable tenancies

  • Enhances your reputation as a landlord

In a more regulated market, professionalism and transparency are increasingly important.

Landlord Insurance

While landlord insurance is not strictly a legal requirement, it is considered an essential part of responsible property letting.

A standard home insurance policy is typically not sufficient for rental properties. Landlords should ensure they have appropriate cover in place, which may include:

  • Building and contents insurance

  • Public liability cover

  • Loss of rent protection

  • Cover for accidental or malicious damage

Having the right insurance protects your investment against unexpected events and provides financial security in the event of damage, disputes, or loss of income.

In practice, most lenders will also require adequate insurance as a condition of a mortgage on a rental property.
